Comprehensive research will include confirmation of clear title to the Developer or Constructor to the land on which will be built. A confirmation that all sales contracts are written in both English and Spanish and correspond accordingly.
A clear understanding as to whether or not the Investor can re assign i.e. sell on the purchase contract prior to completion date and that this can be arranged by the Developer without further cost.
All of the highlighted Investment opportunites are supported by the Developers offerring Bank Guarantees to all Investors.
This means that should in the unfortunate event of a developer failing to complete a project as stated in the sales contract the Investor will receive back all deposit monies paid. Also research has been carried out in respect of the financial "solidity" of the Institutions responsible for these guarantees. It is also essential to know that if a Developer has any funding secured against the land and/or buildings will be fully redeemed in full on the day of completion,"firma de la escritura", and therefore the new Owner will receive clean title.
Finally all the payment terms advertised and marketed by the Developer are those that are stated in the Sales contract with the corresponding VAT "IVA" levied which currently is charged at 7%. Many of the new Overseas Property agents feel the need to promote properties in "emerging markets" where the Investor is given no such assurances of clean title and there are no supporting bank guarantees which for many does not represent a sound financial investment despite the very inexpensive price tag.
